1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BoostMyCase ("Company," "we," "us," or "our") governing your access to and use of the boostmycase.com website and related services (collectively, the "Service").

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

BoostMyCase provides a technology platform that helps users prepare litigation packets to file federal mandamus lawsuits against the United States Citizenship and Immigration Services (USCIS) for unreasonably delayed immigration cases. Our Service includes:

  • Automated generation of court forms (AO440 Summons, AO445 Civil Cover Sheet)
  • Assignment of appropriate U.S. Attorney and Federal Court based on your location
  • Compilation of comprehensive litigation packets with all necessary documents
  • Secure document storage and access to your generated materials
  • User dashboard to track case status and manage information

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Have a pending USCIS case that has experienced unreasonable delays
  • Provide accurate and complete information during registration and throughout your use of the Service
  • Comply with all applicable local, state, federal, and international laws

By using the Service, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

4. Account Registration and Security

To access certain features of the Service, you must register for an account. You may register using Google OAuth or other authentication methods we provide.

4.1 Account Information

You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security of your account credentials and not share them with others
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false or misleading information
  • Conduct that damages our reputation or business

5. Service Fees and Payment

5.1 Pricing

Our Service is provided for a one-time fee of $699. This fee covers:

  • Generation of all required court documents
  • Complete litigation packet preparation
  • Secure document storage
  • Access to your user dashboard
  • Customer support

Payment must be made in full before we generate your litigation packet. We accept payment through Stripe, our secure payment processor.

5.2 No Recurring Charges

This is a one-time payment. We do not charge subscription fees or recurring charges unless you explicitly agree to additional services.

5.3 Taxes

You are responsible for any applicable taxes, duties, or government fees associated with your purchase.

5.4 No Refunds for Completed Services

Once we have generated and delivered your litigation packet, payments are generally non-refundable except as provided in our Refund Policy (Section 6).

6. Service Expectations and Refund Policy

✓ Fast Movement

Most petitioners see case activity within 15–20 days after filing, as WOM actions prompt USCIS to review delayed cases promptly. If USCIS does not take action on your case after filing, you may be eligible for a refund.

6.1 Eligibility Criteria

To be eligible for a refund:

  • You must have completed payment for our Service
  • You must have properly filed your case following our instructions
  • USCIS must not have taken any action on your case (no approval, denial, RFE, interview notice, or other substantive action)
  • You must submit a refund request through your user dashboard
  • You must provide any requested documentation to verify your case status

6.3 Final Sale Policy

The refund policy does not apply if:

  • USCIS has taken any action on your case (approval, denial, RFE, interview, etc.)
  • You provided false or inaccurate information in your intake form
  • You failed to follow proper filing procedures for your lawsuit
  • The delay in your case is due to factors outside USCIS's control
  • You have received a refund from us for any previous case

Each customer is eligible for only one refund under this policy. If you have previously received a refund, you are not eligible for future refunds.

7. User Obligations and Prohibited Conduct

7.1 Accurate Information

You are solely responsible for the accuracy and completeness of all information you provide to us. You agree to:

  • Provide truthful, accurate, and complete information in all forms
  • Double-check all information before submission
  • Review generated documents carefully before filing
  • Notify us immediately of any errors or inaccuracies

7.2 Prohibited Uses

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Provide false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove, modify, or obscure any copyright or proprietary notices
  • Use the Service to harm, threaten, or harass others
  • Upload viruses, malware, or other malicious code
  • Resell or commercially exploit the Service without authorization

8. Intellectual Property Rights

8.1 Our Property

The Service and all content, features, and functionality (including but not limited to software, text, graphics, logos, images, and design) are owned by BoostMyCase or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

8.3 Your Content

You retain all rights to the information and documents you upload to the Service. By uploading content, you grant us a limited license to use, store, and process your content solely for the purpose of providing the Service to you.

8.4 Generated Documents

You own the litigation packet and documents we generate for you. You may use them freely for their intended purpose of filing your lawsuit. However, you may not resell, redistribute, or use our document generation technology for commercial purposes.

Nothing on this website or in our Service should be construed as legal advice. You should consult with a licensed attorney for legal advice specific to your situation.

9.2 No Outcome Guarantee

We do not guarantee any specific outcome for your immigration case or lawsuit. Results depend on many factors outside our control, including:

  • The merits of your individual case
  • USCIS policies and procedures
  • Court rulings and judicial discretion
  • Changes in immigration law or policy
  • How you present and argue your case

9.3 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOSTMYCASE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • LOSS OF IMMIGRATION BENEFITS OR OPPORTUNITIES
  • DENIAL OR DELAY OF YOUR IMMIGRATION CASE
  • DEPORTATION OR REMOVAL PROCEEDINGS
  • ANY DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE (i.e., $699).

9.5 User Responsibility

You acknowledge and agree that:

  • You are solely responsible for reviewing all generated documents
  • You are solely responsible for filing your lawsuit correctly
  • You are solely responsible for any legal consequences of your lawsuit
  • We are not liable for errors in information you provide
  • We are not liable for your failure to follow proper legal procedures

10. Indemnification

You agree to defend, indemnify, and hold harmless BoostMyCase and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Any false, misleading, or inaccurate information you provide
  • Any lawsuit or legal action you file

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at support@boostmycase.com to attempt to resolve the issue informally.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in the United States in a location determined by the arbitrator.

11.3 Class Action Waiver

YOU AND BOOSTMYCASE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.4 Exceptions

Notwithstanding the above, either party may seek equitable relief in court to protect intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

To the extent that arbitration does not apply, you agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction in such courts.

13. International Users

Our Service is operated in the United States and is intended for users in the United States. If you are accessing the Service from outside the United States, you are responsible for compliance with local laws.

By using the Service, you consent to the transfer of your information to the United States, where data protection laws may differ from those in your jurisdiction.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us at support@boostmycase.com. Termination does not entitle you to a refund as all sales are final per Section 6.

14.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include but are not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false information
  • Abusive behavior toward our staff or other users
  • Chargebacks or payment disputes

14.3 Effect of Termination

Upon termination:

  • Your right to access the Service immediately ceases
  • We may delete your account and all associated data (subject to legal retention requirements)
  • You remain liable for any outstanding fees or obligations
  • Sections of these Terms that by their nature should survive termination shall survive (including intellectual property, disclaimers, limitations of liability, and indemnification)

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BoostMyCase regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

The section headings in these Terms are for convenience only and have no legal or contractual effect.
